Transfer of Equity
If you want to transfer a property out of your name and into the name of someone else, then there are two ways you can do this: A conventional sale or a transfer of equity.
Our experienced transfer of equity lawyers are more than capable of assisting a variety of clients who have decided that they want to change the ownership arrangements in respect of a property, either by taking a name off or by adding a name on, and whether it be via a spouse to spouse transfer for tax purposes, a transfer from parents to children to facilitate a planned inheritance or simply a wish between co-owners to transfer full ownership to just one of them, either by way of gift or in return for some form of consideration.

Unregistered Property
An unregistered property has not been registered with the Land Registry. The property will still be owned, but the property details will only be documented in the Title Deeds. When buying or selling an unregistered property, difficulties may occur when finding or proving who the legal owners are, as there is no central record of the ownership to search for in the Land Registry.
If you wanted to sell an unregistered property, you would need to produce the physical title deeds. You would then give the deeds to the buyer’s conveyancer following the sale, who would have the option to apply for the property to be registered. You would also have to go through your conveyancer to provide evidence of title to the buyer by presenting physical ownership documentation from at least 15 years previous up until the present day.

Auction Property
